99% of all disputes are settled without the need of costly
litigation. Many are settled with the help of a neutral and objective third
party helping facilitate discussions between the parties. Alternative dispute
resolution is an opportunity for both parties to craft an agreement they have
had some input into creating versus the winner take all judgment given by the
court. Granted, it is not the ultimate solution like the winner of the
courtroom, but it does allow for an agreement both sides can live with while
avoiding the risk of the courtroom. Why does that sound good? Because in the
courtroom there is a winner and a loser.
